To the fullest extent permitted by applicable law, all warranties, representations, conditions and terms implied by statute, common law, equity, custom, trade usage or otherwise are excluded.
To the fullest extent permitted by applicable law, if any Cyclect Party is found liable despite the exclusions above, the total aggregate liability of all Cyclect Parties arising out of or in connection with the website, content, downloads, Submissions or these Terms shall be limited to Singapore Dollars Ten (S$10).
Nothing in these Terms excludes or limits any liability to the extent that such exclusion or limitation is prohibited by applicable law.

Cyclect may assume control of the defence or settlement of any matter subject to indemnity. You must cooperate fully with Cyclect and must not settle any matter without Cyclect’s prior written consent.
This indemnity is in addition to, and does not limit, any other rights or remedies available to Cyclect under law, equity, contract or these Terms.
15. Enforcement
Cyclect may, without prior notice and without liability, take any action it considers appropriate where it suspects breach of these Terms, misuse of the website, unlawful conduct, security risk, operational risk, reputational risk or infringement of Cyclect’s rights.
Such action may include:
- blocking, limiting, suspending or terminating access;
- removing, disabling or rejecting Submissions;
- investigating activity on or relating to the website;
- preserving, reviewing or disclosing relevant information where permitted or required by law;
- reporting conduct to authorities, regulators, affected parties or service providers;

16. Protected Parties and Third-Party Rights
The disclaimers, exclusions, limitations of liability, indemnities and enforcement rights in these Terms are intended to benefit the Cyclect Parties.
To the extent permitted by law, each Cyclect Party may rely on and enforce the relevant provisions of these Terms under the Contracts (Rights of Third Parties) Act 2001.
Except for the Cyclect Parties, no other person who is not a party to these Terms shall have any right to enforce any provision of these Terms.
Cyclect may amend, vary, suspend, terminate or enforce these Terms without requiring the consent of any Cyclect Party or any other third party.

18. General Terms
If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, lawful and enforceable. If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.
Failure by Cyclect to enforce any provision of these Terms shall not constitute a waiver of that provision or of any right, remedy or power of Cyclect.
These Terms constitute the entire agreement between you and Cyclect regarding access to and use of the website. They do not replace any signed written agreement between you and Cyclect relating to a project, quotation, proposal, purchase order, supply, service, maintenance, employment, confidentiality, partnership or other commercial arrangement.
